Lê Ân đúng là đại gia khiến người ta lúc nào cũng phải nhắc đến! Sau nhiều thời gian theo đuổi, cuối cùng th́ phiên ṭa phúc thẩm cũng đă khép lại. Đại gia Lê Ân cùng người vợ trẻ kém ông 55 tuổi vui vẻ nhận phán quyết.

Ngày 25/5, sau thời gian xét xử và nghị án, TAND TP.HCM đă bác đơn kháng cáo của ông Lê Đa Ni E., giữ nguyên bản án sơ thẩm.
Hủy Giấy chứng nhận là có căn cứ

Theo đó, ṭa không chấp nhận yêu cầu của ông E. đề nghị hủy Quyết định hành chính số 32 của UBND quận Tân B́nh về việc hủy bỏ Giấy chứng nhận Quyền sử dụng đất mà quận này đă cấp cho bà Lê Ngọc Linh, người từng được xác định là chủ sở hữu căn nhà 408, đường Cách Mạng Tháng 8, phường 4, quận Tân B́nh, TP.HCM.
Trong phần tuyên án, HĐXX đă nhắc lại toàn bộ quá tŕnh tranh chấp căn nhà 408 Cách Mạng Tháng 8, quận Tân B́nh, TP.HCM giữa đại gia Lê Ân và người vợ cũ là bà Lê Ngọc Linh. Theo ṭa, từ năm 1988 đến nay, vụ kiện tranh chấp tài sản sau ly hôn giữa ông Lê Ân và bà L. đối với căn nhà 408 trên hiện vẫn chưa được giải quyết bằng một bản án hay quyết định có hiệu lực pháp luật nào.
Thế nhưng 14/8/2005, dựa theo đơn tŕnh bày của bà Linh và cho rằng căn nhà không có tranh chấp, UBND quận Tân B́nh cấp Giấy chứng nhận Quyền sử dụng đất số H00077/26968 cho bà Linh đối với căn nhà 408, đường Cách Mạng Tháng 8 trên là không đúng quy định của pháp luật.

Do đó, ngày 5/2/2013, Ủy Ban Nhân dân Quận Tân B́nh đă ra quyết định số 32/QĐ - UBND hủy bỏ Giấy chứng nhận Quyền sử dụng đất số H00077/26968 đă cấp cho bà Lê Ngọc Linh đối với căn nhà 408 là hoàn toàn có căn cứ, đúng pháp luật. Từ đó, ṭa bác đơn kháng cáo của ông E. về yêu cầu hủy quyết định này.
Đại gia và những vụ kiện
Không chỉ nổi tiếng về sự giàu có, độ chơi sang và quyết định cưới người vợ thứ 6 kém ḿnh 55 tuổi, tỷ phú Lê Ân c̣n được dư luận biết đến với nhiều vụ kiện tranh chấp, trong đó có tranh chấp căn nhà trên với người vợ cũ kéo dài suốt 30 năm đến nay chưa kết thúc.
Theo nội dung vụ việc, năm 1965, đại gia Lê Ân và bà Linh kết hôn, cùng chung sống tại căn nhà số 408 Cách Mạng Tháng 8, quận Tân B́nh, TP HCM. Căn nhà này do ông đứng tên. Năm 1980, ông vượt biên và bị bắt sau đó bà Linh đệ đơn ra ṭa ly hôn. Hai bên thuận t́nh ly hôn nhưng sau đó phát sinh tranh chấp về tài sản do ṭa giao cho bà Linh cả hai căn nhà là 408 Cách Mạng Tháng 8 và một căn nhà ở Nha Trang.
Ông Ân khiếu nại yêu cầu ṭa cấp trên xem xét lại việc phân chia tài sản. Sau đó, TAND TP.HCM giữ nguyên phần quyết định công nhận việc thuận t́nh ly hôn và hủy phần quyết định giải quyết về tài sản, giao hồ sơ cho TAND quận Tân B́nh xét xử lại.
Khi vụ kiện trên chưa có kết quả, năm 2000, ông Ân lại bị bắt v́ liên quan một vụ án của ngân hàng VCSB do ông lập ở Vũng Tàu, do đó quá tŕnh tranh chấp bị gián đoạn.
Ngày 14/8/2005, bà Linh được UBND quận Tân B́nh cấp Giấy chứng nhận Quyền sử dụng đất số H00077/26968 đối với căn nhà trên. Sau hàng loạt khiếu nại, khiếu kiện của vị đại gia, ngày 5/2/2013, Ủy Ban Nhân dân Quận Tân B́nh đă ra quyết định số 32/QĐ - UBND hủy bỏ Giấy chứng nhận Quyền sử dụng đất số H00077/26968 mà UBND quận Tân B́nh đă cấp cho bà Lê Ngọc Linh đối với căn nhà 408, đường Cách Mạng Tháng 8, phường 4, quận Tân B́nh, TP.HCM.
Là người được mẹ chuyển quyền sở hữu lại căn nhà trên, con trai đại gia Lê Ân là ông Lê Đa Ni E. khởi kiện ra ṭa yêu cầu hủy quyết định hành chính số 32 của UBND quận Tân B́nh. Được xác định là người có quyền lợi và nghĩa vụ liên quan, đại gia Lê Ân cũng được triệu tập đến ṭa.
Sau khi nghe phán quyết, đại gia Lê Ân cùng vợ trẻ khá vui vẻ. Ông tự hào khoác tay người vợ trẻ và nói rằng đó là người đồng hành "chủ chốt" của ông. Ông và vợ trẻ cũng cho biết ngày mai sẽ tham gia một phiên xử khác tại TAND tỉnh Bà Rịa – Vũng Tàu với tư cách là nguyên đơn.
Trong vụ kiện này, ông đề nghị TAND tỉnh Bà Rịa – Vũng Tàu tuyên hủy Giấy chứng nhận Quyền sử dụng đất đă cấp cho một hộ dân. Lư do theo vị đại gia là trong thời gian ông đi vắng, nhiều hộ dân đă lấn chiếm trái phép vào đất của Khu du lịch Chí Linh. Do vậy, ông đề nghị hủy lại các giấy chứng nhận này.
