Trong lần về nước thấy mắt mờ, một Việt kiều Mỹ đi khám được bác sĩ tư vấn phẫu thuật bằng phương pháp phaco. Không ngờ, sau lần phẫu thuật mắt ông không sáng hơn mà có nguy cơ bị hỏng vì biến chứng. Ông khởi kiện ra tòa đòi bệnh viện bồi thường gần 80.000 USD.Ngày 1/4, TAND TP.HCM đã tiến hành tuyên án vụ tranh chấp đòi bồi thường thiệt hại ngoài hợp đồng giữa nguyên đơn là ông Nguyễn Hữu Thông (Việt kiều Mỹ) và bị đơn là Công ty TNHH Bệnh viện Mắt Thái Thành Nam (quận 1, TP.HCM).
Theo đơn khởi kiện, phía nguyên đơn trình bày: tháng 6/2009, trong lần về nước, ông Nguyễn Hữu Thông thấy mắt hơi mờ nên đến bệnh viện Mắt Sài Gòn (chi nhánh Bệnh viện mắt Thái Thành Nam) khám.

Tại đây, bác sĩ khám và chẩn đoán ông Thông bị đục thủy tinh thể và chỉ định phẫu thuật bằng phương pháp phaco.
Ngày 5/6/2009, ca phẫu thuật diễn ra nhưng không đem lại hiệu quả, thậm chí sau đó ông Thông không nhìn thấy nữa. Ông tiếp tục đến gặp bác sĩ thì được kê đơn thuốc uống và thuốc nhỏ mắt.
Không yên tâm, ông Thông tiếp tục đến Bệnh viện Mắt TP.HCM khám lại thì được chẩn đoán mắt bị loạn dưỡng giác mạc, loét giác mạc, sẽ mù vĩnh viễn nếu không có biện pháp chữa trị kịp thời.
Quá sợ hãi, ông Thông trở về Mỹ đến điều trị ở bệnh viện San Francisco General với chi phí hết 46.700 USD.
Sau thời gian điều trị, ông Thông về lại Việt Nam và kiện bệnh viện mắt ra tòa đòi bồi thường hơn 85.000 USD bao gồm chi phí điều trị, mất thu nhập, chi phí đi lại...
Tại tòa, phía nguyên đơn giữ nguyên yêu cầu khởi kiện nhưng chỉ đòi bồi thường hơn 79.000 USD, thay vì 85.000 USD trước đó.
Về phần mình, đại diện Bệnh viện Mắt Sài Gòn không đồng ý bồi thường vì "đã làm đúng quy trình". Đại diện phía bệnh viện cũng lý giải rằng trong mổ phaco có tỉ lệ nhỏ bị biến chứng và bệnh viện đã tư vấn đầy đủ cho ông Thông trước khi phẫu thuật.
Ngoài ra, sau khi mổ bệnh viện vẫn đang theo dõi, chăm sóc sau phẫu thuật thì bệnh nhân lại tự ý bỏ đi, không đến tái khám theo quy định. Phía bị đơn cũng khẳng định nếu ông Thông bị biến chứng nhưng báo với bệnh viện thì đơn vị này hoàn toàn có thể chữa trị được.
Trước lập luận của bị đơn, ông Thông khẳng định trong lần khám cuối cùng bệnh viện không hẹn ông ngày tái khám. Khi về Mỹ, ông tiếp tục liên lạc với bệnh viện và bác sĩ để thông báo tình trạng bị biến chứng thì các bác sĩ ở đây nói cứ tiếp tục điều trị, chi phí thế nào sau này họ sẽ thanh toán lại.
Trước đó, bệnh viện từng đưa ra mức hỗ trợ 7.500 USD sau đó nâng lên 25.000 USD nhưng ông không đồng ý.
Sau khi nghị án, HĐXX nhận định căn cứ vào hồ sơ vụ án và các chứng cứ do hai bên cung cấp, HĐXX xét thấy: sau khi mổ ông Thông đã được bệnh viện tái khám. Cũng trong ngày 20/6 (sau khi tái khám) ông Thông tự ý bỏ về Mỹ nhưng không có thỏa thuận gì với bệnh viện.
Tại phiên tòa, ông Thông trình bày sau khi về Mỹ giữa ông và các bác sĩ có trao đổi và hứa hẹn qua điện thoại nhưng tại tòa phía bị đơn phủ nhận lời khai trên.
Ngoài ra, trong biến chứng y khoa có nhiều nguyên nhân như do cơ địa, hạn chế tay nghề, sai sót y khoa, điều trị không đúng...Do đó, không đủ cơ sở kết luận nguyên nhân dẫn đến phù và loạn dưỡng giác mạc của ông là do bác sĩ mổ. Từ đó, Tòa không chấp nhận yêu cầu khởi kiện của nguyên đơn.

Mấy tên này chết cũng đáng đời. Ở Mỹ thì lười biếng ăn WELFARE. Ăn không dám, mặc cũng không mà lại đi mang tiền về cho đám đồ tể mổ như mổ Lợn. Kiện ai? Không chừng nó luộc cho bỏ mạng luôn chứ ở đó mà kiện.

Nếu là Vịt kiều Canada thì được giải phẩu miễn phí, đâu cần phải về VN.
Trừ khi giải phẩu thẩm mỹ thì về VN rẻ hơn nhưng phải chịu đấm ăn xôi - Hên, Xui.
