Twitter và hầu hết công ty mạng được bảo vệ bởi đạo luật 230 của bộ luật Truyền Thông Đứng Đắn (Communications Decency Act) để tránh bị lôi vào những vụ kiện dính dáng đến việc phỉ báng, bôi nhọ danh dự cá nhân..... đạo luật này được Quốc Hội thông qua vào năm 1996 khi mạng lưới thông tin vừa mới ra đời. Đạo luật này được ban hành nhằm phân biệt rõ ai là người chịu trách nhiệm một khi có ai đó bị tổn thương trên mạng.


Twitter và hầu hết các trang mạng mà người ta dùng để viết bất kể thượng vàng hạ cám trên đó được coi như là diễn đàn phân phối hơn là nhà xuất bản. Thành thử nếu có ai đó bị bề hội đồng trên mạng như Twitter chẳng hạn và tìm đến cái chết, hoặc uống thuốc tẩy quần áo mà mất mạng vì Trump tuýt bảo thuốc tẩy trị được bịnh, thì Twitter sẽ không thể bị kiện vì nó không phải là nhà xuất bản. Nạn nhân hoặc gia đình nạn nhân có thể kiện người gây ra vụ việc, trong trường hợp này là Trump, nhưng không được kiện diễn đàn phân phối tin này. Cũng giống như khi gặp tai nạn xe cộ, nạn nhân có thể kiện người lái xe gây tai nạn chứ không thể kiện con đường nơi xảy ra tai nạn.

Trong khi đó, nếu là nhà xuất bản thì quyền lợi này không có. Nhà xuất bản không được miễn tố về những vụ kiện liên quan đến phỉ báng hoặc bôi nhọ danh dự cá nhân ai đó, khi họ đã biết mà vẫn cố tình in những nội dung đó. Quy luật này vẫn được áp dụng cho tất cả các công ty truyền thông có trách nhiệm hiệu đính, chỉnh sửa và phát hành ấn phẩm tới quần chúng.

Hôm nay Trump ra một sắc luật nhằm loại Twitter ra khỏi thành phần được bảo vệ bởi đạo luật Truyền Thông Đứng Đắn phần 230, Trump cho rằng Twitter đã nhúng tay vào với dự định kiểm duyệt, giới hạn, hay hiệu đính nội dung (hầu hết là của Trump), cho nên Twitter phải được xếp vào hàng nhà xuất bản. Phần đông các chuyên gia về luật không đồng ý với quan điểm này. Đã có biết bao nhiêu vụ kiện các diễn đàn phân phối về việc sửa chữa nội dung của những người dùng diễn đàn gửi lên mà không thắng. Việc làm của Trump chẳng đi đến đâu, nhưng tại sao ông ta vẫn làm?

Đây chẳng qua lại là một trong những chiêu trò đánh lạc hướng quần chúng của Trump. Các chiêu trò này chỉ có một bài bản là phát biểu lung tung hay hành động kỳ quặc để hy vọng một trong những điều sau đây sẽ xảy ra:
1) để cho mọi người chú ý đến những chuyện quái gở này mà quên nhãng đi những chuyện tai hại Trump đang gây ra cho dân Mỹ và nước Mỹ, chẳng hạn con số tử vong quá 100,000, và;
2) trì hoãn giải quyết những việc cần phải giải quyết để rồi dần dà những việc đó bị dân chúng quên lãng, ví dụ điển hình là hồ sơ thuế của ông ta, và;
3) hay là lén lút tìm thời điểm thuận lợi nào đó, mang người của mình vào toà án, hoặc là những đồng đảng của ông ta trong Quốc Hội đồng tình ủng hộ ông ta thì kết quả được chuyển hướng về phía ông ta. Giống như vụ hạn chế nhập cư vào Mỹ và cấm Hồi Giáo.

Tóm lại, đây chỉ là việc mò trăng đáy nước, toan sửa đổi một đạo luật đã được Quốc Hội thông qua từ bao giờ, hầu lôi về nhét dưới quyền hành xử của Uỷ Ban Truyền Thông Liên Bang và Uỷ Ban Thương Mại Liên Bang, khi cả hai uỷ ban này là những cánh tay “độc lập” của hành pháp, để gây khó dễ cho Twitter. Dĩ nhiên việc này sẽ gây ra nhiều tranh cãi và tờ đơn sẽ bị đóng mộc “hoãn” cho đến khi toà án phán quyết là có đáng được đem ra xét xử hay không. Tới khi lên tới Toà Án Tối Cao Pháp Viện xét xử thì sự việc cũng đã nguội, không còn giá trị gì nữa, và trong thời gian qua lúc nào tên Trump cũng được nhắc đến trong cương vị một nạn nhân hay là người dám lên tiếng chống đối. Những người phò Trump sẽ tin như vậy.

Trump hành động và nói nhiều điều ngu xuẩn, nhưng nghĩ cho cùng, ông ta không ngu đâu, việc gì cũng có tính toán cả.

Hello everyone, while I am no expert on Constitutional law being an ambulance chaser and a homewrecker (I do a lot of divorces lol) and all that, below is my Cliffsnotes version of what Trump's new order against Twitter really is from the perspective of a small time Viet Town Lawyer. If you can help me with the Viet, in case anyone wants to know, feel free.

Too Long Didn't Read Version:

1. Trump's order is a legal loser and he knows it, but it doesn't matter.

2. It basically seeks to reclassify Twitter from a Platform to a Publisher, therefore allowing people to be able to sue it for a variety of things such as libel, defamation, and negligence and putting it in the oversight jurisdictions of the Federal Communications Commissions and the Federal Trade Commissions. This is the real harassment part of the order.

3. It is not just a mere battle about free speech and censorship. That's the smoke and mirror.

Now for the long one:

Twitter and most Internet Companies are protected from lawsuits (for libel, defamation, negligence, etc) and government oversights under Section 230 of the Communications Decency Act. This of course is a law passed by Congress in 1996 at the dawn of the internet age to address situations about who is liable and should be held accountable if a harm was committed over the internet, either via government intervention or good old civil lawsuits.

Twitter and most internet sites where people post their junks are classified as a Platform or distributor instead of a publisher. So if someone get cyberbullied on Twitter for example, and offed themselves, or drink bleach because Uncle Chump tweeted such and dies, Twitter itself cannot be sued or prosecuted because it's merely a "Platform" instead of a "Publisher."

You can still sue the person causing the harm (Trump), but not the Platform itself. Similar to the same way you can sue the person hitting you with a car, but not the road that the car was driving on.

Publishers in contrast are not immune to lawsuit for libel and defamation if they knowingly published such harmful contents. This traditionally applies to media companies that curates, edits, and publishes its contents to the unwashed masses. A great example was Gawker going out of business for publishing the Hulk Hogan sex tape with Bubba the Love Sponge's wife (eww). Gawker knew what the video was, and how illegal it was, but "published" on its media avenues to for publicity and financial gains. Now if Gawker was Porn Hub or Youtube, and the video was uploaded by its creator there, it might've survived.

Publishers are also beholden to certain governmental oversight such as the FCC, who can fine them for certain behaviors (Janet Jackson Super Bowl anyone?).

Trump's Executive Order today sought to remove Twitter's protection against lawsuits and oversights under Section 230 by saying that because Twitter engages in bias attempts to censor, restrict, or edit contents (mostly his), they should basically be treated as publishers and be subject to oversights by the FCC and the FTC, both of which are supposed to be independent but in reality, the leadership comes under the appointment of the executive branch. The rest of the order goes into details on how this was to be done.

Most legal opinions do not support this position. Long lines of Court cases have protected the right of a content distributor or platform to engage in traditional editorial functions over user created contents. It's a loser, but why did he do it?

To me, this is just another in a long line of distraction method employed by Chumper in Chief. It follows a pattern where he makes outlandish claims and actions, and his legal team hangs their hats on these loser legal positions hoping the following will happen:

1. It provides a distraction from any real harm he's doing to the country, and;

2. It delays any real issues until enough time passes that the issues are no longer relevant in the public eyes (such as his stupid taxes, he knows he'll eventually have to give them up, but he has successfully delayed it so long it really doesn't matter now does it?), and;

3. On the off chance he manages to pack the Court with enough kooks, or if his buddy in Congress gets enough support to do something to obstruct, things might swing his way (like the public charge immigration order, or the Muslim Ban).

So yeah, that's really my two cents. It's a loser attempt at a power grab, away from a law validly passed by Congress, hoping to put it in the jurisdiction of the FCC the FTC, both are supposed "independent" arms of the Federal Government, but really are under his control, allowing them to give Twitter a hard time, all to appease his pettiness.

This order will of-course be challenged and a stay will be put on its application until the legalities are decided by the Court. But by the time the SC gets to decide it, it wouldn't matter anyway and Trump gets all the free publicity as the victim and someone who "fought back." His dumb ass supporters will be eating it up. I'm telling you right now, Trump do and say a lot of stupid things, but he ain't stupid.
