Một người đă sống tại Séc và xin thôi quốc tịch VN để nhập quốc tịch khác, nay lại muốn quay trở lại phải làm sao?Tất nhiên là hỏi luôn là làm thế nào ở đâu?Cùng vietbf.com khám phá thêm.

* Hỏi: Bạn em đang sống tị nạn tại CH Czech và trước kia đă xin thôi quốc tịch Việt Nam để nhập quốc tịch Đức. Giờ bạn em bỏ quốc tịch Đức và muốn quay trở lại quốc tịch Việt Nam th́ phải làm thế nào? Và tới đâu để làm thủ tục?

* Trả lời:
Do bạn của bạn đă xin thôi quốc tịch Việt Nam để được nhập quốc tịch Đức, do đó, sau khi bạn của bạn từ bỏ quốc tịch Đức th́ bạn của bạn sẽ trở thành người không có quốc tịch theo quy định tại Khoản 2, Điều 3, Luật Quốc tịch Việt Nam 2008 (Luật này đă được sửa đổi, bổ sung năm 2014).

Theo quy định tại Luật quốc tịch Việt Nam, để quay trở lại quốc tịch Việt Nam, bạn của bạn phải làm thủ tục Xin trở lại quốc tịch Việt Nam. Tuy nhiên, để xin trở lại quốc tịch Việt Nam th́ bạn của bạn phải thuộc một trong các trường hợp sau:

- Xin hồi hương về Việt Nam;
- Có vợ, chồng, cha đẻ, mẹ đẻ hoặc con đẻ là công dân Việt Nam;
- Có công lao đặc biệt đóng góp cho sự nghiệp xây dựng và bảo vệ Tổ quốc Việt Nam;

- Có lợi cho Nhà nước Cộng ḥa xă hội chủ nghĩa Việt Nam;
- Thực hiện đầu tư tại Việt Nam;

(Điều 23, Luật Quốc tịch Việt Nam)
Nếu như bạn của bạn thuộc một trong các trường hợp nêu trên, bạn của bạn cần chuẩn bị những giấy tờ sau để xin trở lại quốc tịch Việt Nam:
- Đơn xin trở lại quốc tịch Việt Nam;

- Bản sao Giấy khai sinh, Hộ chiếu hoặc giấy tờ khác có giá trị thay thế;
- Bản khai lư lịch;

- Phiếu lư lịch tư pháp do cơ quan có thẩm quyền của Việt Nam cấp đối với thời gian bạn của bạn cư trú ở Việt Nam và Phiếu lư lịch tư pháp do cơ quan có thẩm quyền của nước ngoài cấp đối với thời gian bạn của bạn cư trú tại Cộng hoà Czech. Lưu ư: Phiếu lư lịch tư pháp phải là phiếu được cấp không quá 90 ngày tính đến ngày nộp hồ sơ;

- Giấy tờ chứng minh bạn của bạn đă từng có quốc tịch Việt Nam. Có thể là một trong những giấy tờ sau: Bản sao Giấy khai sinh; bản sao Quyết định cho thôi quốc tịch Việt Nam hoặc Giấy xác nhận mất quốc tịch Việt Nam; giấy tờ khác có ghi quốc tịch Việt Nam hoặc có giá trị chứng minh quốc tịch Việt Nam trước đây;

- Giấy tờ chứng minh đủ điều kiện trở lại quốc tịch Việt Nam đối với từng trường hợp chúng tôi đă nêu ở trên.

(Điều 24, Luật Quốc tịch Việt Nam, Điều 10, Nghị định 78/2009 NĐ-CP và Nghị định97/2014/NĐ-CP hướng dẫn thi hành luật Quốc tịch Việt Nam)
Sau khi hoàn tất các giấy tờ cần thiết, bạn của bạn cần mang hồ sơ đến Cơ quan đại diện Việt Nam tại CH Czech (Khoản 1, Điều 25 Luật Quốc tịch Việt Nam). Cơ quan đại diện Việt Nam sẽ kết hợp với Bộ Tư pháp Việt Nam xác minh về độ chính xác của thông tin hồ sơ. Nếu hồ sơ hợp lệ sẽ được Bộ trưởng Bộ Tư pháp báo cáo Thủ tướng Chính phủ tŕnh Chủ tịch nước xem xét, quyết định.

Cầm cái thẻ thông hành của VC ra nước ngoài là bị người nước ngoài nhổ nước miếng vào mặt rồi, chỉ có mấy thằng ngu giống như thằng Trần Trường ǵ đó !

Dành nhửng thư nầy cho ông cố nội, giòng họ chúng bây đi nhá !
Chúng bây nên mua nhiều kiếng để nhìn mặt chó chúng bây là ai chứ đừng mở miệng nói mà không suy nghỉ.

Ace đừng nóng, ḿnh nên đọc cho kỹ trước!
