(Washington Post) – Toà Phúc thẩm Liên bang vào hôm thứ Tư phán quyết, Quốc hội có thể có hồ sơ khai thuế 8 năm của Tổng thống Donald Trump. Quyết định này đẩy tranh chấp phân chia quyền lực tiến một bước gần hơn tới Tối cao Pháp viện.

Toà Phúc thẩm khu vực D.C vào ngày Hạ viện tổ chức buổi điều trần điều tra luận tội công khai đầu tiên đă giữ nguyên phán quyết chống lại Tổng thống trước đây, khẳng định quyền lực điều tra của Quốc hội,

Các luật sư của ông Trump cho hay, họ chuẩn bị thỉnh nguyện Tối cao Pháp viện can thiệp vào vụ này, cũng như vào những cuộc chiến pháp lư khác giữa Tổng thống và Quốc hội.

Toà phúc thẩm khu vực D.C vào hôm thứ Tư trả lời ông Trump về yêu cầu có toàn bộ hội đồng phúc thẩm tái xét xử phán quyết được hội đồng phúc thẩm gồm 3 vị thẩm phán đưa ra vào tháng 10, trong đó phản đối lập luận đ̣i ngăn chặn không cho các nhà lập pháp thực thi trát đ̣i tài liệu khai từ công ty kế toán lâu năm của ông Trump.

Đa số 11 vị thẩm phán trong toà bỏ phiếu chống lại việc tái xét xử. Ba thẩm phán Neomi Rao, Gregory Katsas và Karen LeCraft Henderson chấp thuận tái xét xử và công bố bất đồng. Rao và Katsas là cựu viên chức chính phủ Trump, và được Tổng thống đề cử vào toà.

Án lệnh của toà không có nghĩa hồ sơ khai thuế của Trump sẽ được giao cho Quốc hội ngay lập tức. Toà Phúc thẩm D.C trước đây cho hay, họ sẽ giữ lại phán quyết trong 7 ngày để các luật sư của Tổng thống có đủ thời gian để thỉnh nguyện Tối cao Pháp viện.

Các luật sư của ông Trump cũng dự tính yêu cầu toà cấp cao nhất ngay vào hôm thứ 5 ngăn chặn trát đ̣i tương tự đối với hồ sơ khai thuế của Tổng thống từ biện lư quận Manhattan – người đang điều tra các khoản chi trả bị miệng xảy ra trong bầu cử 2016. Toà Phúc thẩm New York trong tháng này đă ra phán quyết chống lại Trump, từ chối ngăn chặn trát đ̣i công ty kế toán sổ sách Mazars USA.

Hồ sơ ở toà D.C tập trung vào trát đ̣i được Uỷ ban Giám sát Hạ viện tống đạt đến Mazars vào tháng 3, đ̣i hồ sơ tài chánh của Tổng thống. Trát đ̣i này diễn ra nhiều tháng trước khi Hạ viện khởi sự điều tra luận tội Tổng thống liên quan đến những nỗ lực gây áp lực buộc Ukraine điều tra đối thủ chính trị Joe Biden.

Yêu cầu tài liệu được Uỷ ban Giám sát Hạ viện gởi ra sau phiên điều trần của cựu luật sư cho ông Trump. Ông Michael Cohen khai, Trump đă phóng đại tài sản khi vay nợ. Các nhà lập pháp đang điều tra những xung đột về quyền lợi tiềm năng, trong đó có sự chính xác trong những tiết lộ về tài chánh của tổng thống.

2/3 thẩm phán trong Hội đồng phúc thẩm hồi tháng 10 cho rằng, Uỷ ban Hạ viện đă ban hành trát đ̣i cho “những theo đuổi lập pháp hợp pháp, không phải v́ mục đích thực thi công lực không chấp nhận được” như các luật sư của Tổng thống lập luận.

“Trái ngược với những tranh căi của Tổng thống, Uỷ ban có quyền theo cả những Quy định của Hạ viện và Hiến pháp để ban hành trát đ̣i, và Mazars phải tuân thủ,” thẩm phán David Tatel cùng thẩm phán Patricia Millett ghi trong phán quyết. Cả hai đều được các tổng thống Dân chủ đề cử. Trong khi đó, thẩm phán phản đối, bà Rao khẳng định quan điểm rằng, uỷ ban đă vượt quá quyền hạn với trát đ̣i.
