Old  Default CSVN vi phạm pháp luật để quốc tang nhà lănh đạo Cuba Fidel Castro
Ban chỉ huy Trung ương Đảng CSVN ra thông cáo để Quốc tang ông Fidel Castro vào ngày 4/12/2016.Sự ra đi của nhà lănh tụ Cuba là niềm thương tiếc,đau xót đối với Đảng CSVN.Nhưng việc Trung ương Đảng CSVN ra thông cáo đặc biệt để Quốc tang ông Fidel Castro có đang làm trái pháp luật Việt nam?
[Chưa bàn tới việc đây nên là 'quốc' tang hay chỉ là 'đảng' tang, chỉ bàn về khía cạnh pháp lư của thông cáo.]

Nghị định 105/2012/ND-CP quy định việc lễ quốc tang cho cá nhân chỉ áp dụng trong những trường hợp sau:

(1) Bốn vị trí cao nhất trong hệ thống chính trị: Tổng bí thư, Chủ tịch nước, Thủ tướng, Chủ tịch Quốc Hội.

(2) Bộ Chính trị quyết định quốc tang cho CÁN BỘ CẤP CAO khác, có công lao đặc biệt, uy tín quốc tế to lớn.

Mà một trong những điều kiện để là CÁN BỘ, theo Luật Cán bộ Công chức 2008, phải là 'công dân Việt Nam'.

Đối chiếu pháp luật hiện hành, Fidel không thuộc diện được tổ chức quốc tang ở Việt Nam.

Trung ương Đảng Cộng sản Việt Nam, Quốc Hội, Chính phủ, Mặt trận Tổ quốc cần phải làm rơ căn cứ pháp lư cho thông cáo này, bằng không cả 4 cơ quan này đang nêu gương xấu vi phạm pháp luật.
