VBF-Vừa qua sự kiện gây xôn xao khi Hùng Cửu Long người tự lên tiếng có đứng bên cờ đỏ sao vàng đă đến thương xá Phước Lộc Thọ. Tại đây các bà con đă ra chửi mắng và đuổi tên này dưới sự chứng kiến của cảnh sát Mỹ. Tuy nhiên cơ sở pháp lư để có thể trục xuất hay cấm y quay lại c̣n chưa thể đi vào hiện thực.

Gần đây, có rất nhiều bà con Việt kiều đặt câu hỏi rằng Hùng Cửu Long – người đă lên tiếng thách thức cộng đồng người Việt ở California rằng sẽ mặc áo cờ đỏ sao vàng đến Mỹ liệu có bị cấm quay lại Mỹ hay không?


Liên quan đến việc giám đốc công ty vàng bạc đá quư Cửu Long (Cửu Long Jewelry) ở Việt Nam, ông Lê Đ́nh Hùng sang Mỹ, thách thức cộng đồng người gốc Việt tị nạn ở Bolsa, có rất nhiều thông tin cho rằng anh ta vi phạm luật Mỹ, đặc biệt là tội gây rối và sẽ khó có thể trở lại đây.

Trước khi sang Mỹ theo visa du lịch, Lê Đ́nh Hùng đă lên mạng Facebook tuyên bố sẽ mặc cờ đỏ sao vàng đến Thương xá Phúc Lộc Thọ, quận Cam, để “hoà giải, hoà hợp dân tộc” với cộng đồng người Mỹ gốc Việt tại đây. Tuyên bố của anh ta làm tức giận rất nhiều người Việt tị nạn. Nhiều người không bỏ công sáng chủ nhật chờ anh ta.

Theo miêu tả của những người tham gia chống đối, Hùng mặc quần đỏ, đội nón đỏ, áo khoác ngoài màu đen, áo dài màu vàng, quàng khăn đỏ sọc caro. Trông thấy bóng dáng anh ta, nhiều người hét lớn, “Việt cộng cút đi,” “Việt công cút về nước,” “Đồ hèn,” “Tụi tao không hèn như việt cộng,” … Xô xát xảy ra. Có người nhảy vào tặng anh ta nguyên quả đấm, đá, giật điện thoại, đ̣i phá máy quay phim, có người hất luôn ly café vào mặt, … Căng thẳng, giận dữ tăng cao. Lúc anh ta lên xe taxi chuẩn bị bỏ đi th́ một loạt xe cảnh sát đến.

Quả thật, nếu không có cảnh sát th́ anh chàng này có lẽ c̣n nhiều rắc rối. Theo một đoạn băng tự quay được đăng trên mạng YouTube, cảnh sát mời Hùng ra khỏi xe, hỏi han sự việc. Anh ta giải bày, chỉ muốn đến để bày tỏ sự thân thiện, “hoà giải hoà hợp” nhưng bị chống đối, hành hung. Viên cảnh sát gốc Việt hỏi có ghi h́nh lại bị hành hung hay không, có muốn cáo buộc những người đă hành hung hay không, anh ta trả lời, “vết thương không đáng kể,” và không muốn cáo buộc. Cảnh sát khuyên người này nên rời khỏi khu vực, về khách sạn, nhưng v́ chiếc xe taxi anh ta mướn đă bỏ đi, anh ta lại không thể gọi Uber, nên cảnh sát quyết định dùng xe tuần cảnh đưa Hùng đến trạm xe taxi để từ đó có thể về khách sạn.



Căn cứ theo đoạn băng và đối thoại giữa cảnh sát th́ việc anh ta bị bắt không xảy ra. Có thể người đứng ngoài nh́n thấy cảnh sát chở người này đi nên nghĩ anh ta bị bắt.

Chúng tôi đến tư vấn với luật sư Nguyễn Hoàng Duyên để có thể tường tận hơn về căn cứ pháp lư buộc tội Lê Đ́nh Hùng theo những lời đồn đại.

Khi được hỏi, nếu đúng như những ǵ xảy ra như vậy, liệu anh ta có đúng đă vi phạm Penal Code § 415(1) và Penal Code § 415(2) gây rối nơi công cộng hay không, Luật sư Duyên cho rằng, mặc dù không chứng kiến sự việc nhưng dựa vào đoạn băng th́ không có căn cứ nào để buộc tội người này. Anh ta chưa có hành động ǵ gây rối, sự ồn ào là do người dân chống đối sự xuất hiện của anh ta.

Luật sư cũng cho rằng, xin một lệnh cấm đến gần – restraining order – cũng không đủ cơ sở pháp lư. Khả năng để được toà phê chuẩn cũng rất khó. Theo Luật sư Duyên, căn cứ vào đoạn băng th́ cảnh sát thành phố Wesminter đă hành xử rất chuyên nghiệp.



Theo phân tích luật pháp của luật sư Nguyễn Hoàng Duyên th́ Lê Đ́nh Hùng không vi phạm luật pháp Hoa Kỳ, không bị nhà chức trách “sờ gáy” trong sự việc trên, và những thông tin có lẽ bị phóng đại.

Tuy nhiên, việc một người từ Việt Nam dám công khai thách thức cộng đồng người Việt tị nạn, cho dù lư do ǵ đi nữa th́ đều dễ bị lên án và chống đối. “Ḥa hợp, hoà giải dân tộc” chỉ có những người trong nước rêu rao v́ họ không hiểu được nỗi đau của hàng trăm ngàn người bị mất mạng ngoài biển khơi, họ không hiểu nỗi đau của những người vợ mất chồng, những đứa con mất cha trong tù cải tạo cộng sản.

Không ai cấm thằng tép râu nầy trở lại Phước Lộc Thọ, nhứng dám trở lại hay không lại là một chuyện khác ! và hậu quả của nó th́ khó mà lường trước ! Cộng đồng người Việt hải ngoại tại đây khi xảy ra sự việc th́ quả là quá hiền và đầy nhân tính !

Vấn đề không phải ở chỗ là luật pháp có cấm hay không, mà là ở chỗ thằng này có dám hẻo lánh đến nữa hay không thôi. Thằng này c̣n hên là đến Mỹ chứ đến Úc hay Canada th́ ôm đầu máu rồi.

Nếu khách quan nh́n từ khía cạnh bên ngoài th́ thằng Hùng này vẫn chưa vi phạm pháp luật tại Mỹ...nhưng sự khiêu khích có tính toán này nghĩ là bên trong nhà nước Việt nam và Mỹ đă có sự tính toán giữa người dân Việt nam sang Mỹ và người Việt tỵ nạn CS...Cho nên đây chỉ là bước mở đầu của nhà nước CS thôi...Người dân Việt tỵ nạn CS tại khu Bolsa này sẽ c̣n gặp nhiều chuyện mà nhà nước CS sẽ mang đến...V́ hiện nay Việt nam cái cột là biết đi th́ nó cũng đi sang nước ngoài...Lượng ngụi trong nước mà có tiển hay ko có tiền đều có nguyện vọng rời Việt nam càng sớm càng tốt...Họ ko đánh lô tô sống chung với Tàu cộng được cho nên nhà nước Việt nam sẽ có những chuơng tŕnh sắp tới này với cộng đồn người Việt tỵ nạn....

Chạy đâu cũng gặp CS ko sớm th́ muộn...Tuy đă ra nước ngoài những ko hẳn trốn được CS...nó sống chung với ḿnh từ ngày đặt chân lên đất khách quê người...Nó sống kế bên cạnh ḿnh bao nhiêu năm...mà bây giờ th́ c̣n phải gặp thêm thành phần CS mới 2015 nữa...Lúc nào cũng bị tụi nó đi theo phá rối...Đó là chủ truơng của nhà nước CS mà người dân Việt ko bao giờ rời xa mà sống yên ổn được...
