Old  Default Đức: Trịnh Xuân Thanh đối mặt án tử hình
Liên quan đến vụ án Trịnh Xuân Thanh sẽ được nhà cầm quyền CSVN đưa ra xét xử trong thời gian tới. Chính phủ Đức vẫn cho thấy những động thái làm tới cùng vụ việc Trịnh Xuân Thanh bị bắt cóc. Truyền thông Đức vừa qua đã dự báo mức án dành cho Trịnh Xuân Thanh.

Ngay sau khi Tòa án Nhân dân TP Hà Nội công bố sẽ xét xử cựu lãnh đạo ngành dầu khí Trịnh Xuân Thanh vào tháng 1/2018, cáo báo của Đức đồng loạt đăng tin về quyết định này và nhận định ông Thanh có thể đối mặt án tử hình.

Hãng tin thông tấn Đức DPA, tuần báo Tấm Gương (Der Spiegel) và các tờ báo lớn khác của Đức hôm 4/12 đăng tải thông tin cựu doanh nhân 51 tuổi Trịnh Xuân Thanh, người mà Bộ ngoại giao Đức cho là bị mật vụ Việt Nam bắt cóc ở Berlin cuối tháng 7, sẽ bị đưa ra tòa xử vào tháng 1/2018.

Chánh án Tòa án Nhân dân TP Hà Nội Nguyễn Hữu Chính hôm 4/12 được truyền thông trong nước dẫn lời nói tại phiên khai mạc một kỳ họp của Hội đồng Nhân dân thành phố rằng ông Thanh sẽ bị xét xử trong 2 vụ án tham nhũng vào đầu năm sau.

“Trong tháng 1/2018 tòa án Hà Nội phải sớm đưa ra xét xử vụ án Trịnh Xuân Thanh và các đồng phạm tội tham ô tài sản tại Tổng công ty Xây lắp dầu khí Việt Nam PVC và vụ án Trịnh Xuân Thanh cùng các đồng phạm cũng tham ô tài sản xảy ra ở Công ty Cổ phần Bất động sản Dầu khí Việt Nam,” ông Chính nói.

Việt Nam cáo buộc ông Thanh làm thất thoát hơn 3.300 tỷ đồng (147 triệu USD) trong thời gian làm lãnh đạo PVC từ 2009-2013. Trong khi chính phủ Đức cáo buộc Việt Nam đã bắt cóc ông Thanh, người đang xin quy chế tị nạn trên đất Đức, thì Hà Nội lại tuyên bố Ông Thanh tự trở về đầu thú.

Các luật sư của ông Thanh ở Đức cho rằng ông Thanh không tự về đầu thú và nhận định ông là “một nạn nhân của cuộc chiến quyền lực trong nội bộ Đảng Cộng sản,” theo DPA.

Tuần trước Tổng bí thư Việt Nam Nguyễn Phú Trọng tuyên bố muốn “khẩn trương” đưa ra xét xử vụ Trịnh Xuân Thanh mà ông cho là “đặc biệt.” Đầu năm nay, người đứng đầu Đảng Cộng sản đã nói rằng sẽ “bắt bằng được Trịnh Xuân Thanh để đưa về nước xét xử.” Nhiều chuyên gia nhận định rằng việc “bắt cóc” ông Thanh về là một phần trong chiến dịch chống tham nhũng của ông Trọng.

Truyền thông Đức cho rằng nếu bị buộc tội, ông Thanh có thể sẽ bị mức án tử hình.

Luật sư Trần Thu Nam của Đoàn Luật sư Hà Nội cho biết đó là mức án cao nhất cho các cáo buộc tham nhũng. “Mức độ tham ô tham nhũng trên 5 tỷ đồng hoặc làm thiệt hại trên 5 tỷ đồng thì có thể bị mức phạt cao nhất là tử hình.”

Theo đánh giá của luật sư Nam, việc ông Thanh bỏ trốn theo cáo buộc của Việt Nam là một trong những tình tiết tăng nặng cũng như số tiền thất thoát quá lớn, như trong vụ này, thì cựu lãnh đạo ngành dầu khí khó có khả năng “thoát án” tử hình.

Chính phủ Đức và sứ quán Đức đang theo dõi chặt chẽ những diễn biến tiếp theo của vụ xử ông Thanh và sẽ đưa ra những quyết định thích hợp cho mối quan hệ song phương với Việt Nam, theo DPA. Cũng theo hãng thông tấn Đức, Việt Nam “đã biết thái độ của Chính phủ liên bang Đức đối với án tử hình.”

Việt Nam là một trong số 58 quốc gia trên thế giới vẫn áp dụng mức án tử hình.

Tờ báo kinh doanh hàng đầu của Đức, Handelsblatt, hôm 4/12 cho rằng những lo ngại về mức án tử hình ở Việt Nam là có cơ sở. Tuần báo này, trong chuyên mục riêng có tên “Trịnh Xuân Thanh” nằm trong trang “Chính trị quốc tế” lấy trường hợp gần đây nhất về việc kết án tử hình cựu giám đốc điều hành Nguyễn Xuân Sơn của PetroVietnam làm 1 ví dụ cho mối quan ngại này.

Các điều luật có án tử hình đã được lượt bỏ rất nhiều trong luật pháp Việt Nam, theo luật sư Nam, nhưng “những vụ án liên quan đến tham nhũng nếu không có hình phạt tử hình” có thể sẽ trầm trọng hơn.

“Khi chưa kiểm soát được tình trạng tham nhũng mà bỏ ngay hình phạt tử hình thì sợ rằng nó sẽ gây tác dụng ngược," theo LS Nam. "Nó bảo đảm quyền sống của một người nhưng nó sẽ làm ảnh hưởng rất nhiều cho xã hội và cho ngân sách nhà nước.”

những tên cầm quyền tại VN tên nào cũng tham nhũng trên 5 tỷ đồng,vậy thì xử chúng nó tử hình hết cho dân đỡ khổ.

Hmmmm, BND chưa kịp lấy thông tin từ thằng Thanh này liên quan đến Deutsche Bank thì bị phỗng tay trên nha, thế nào cũng dính líu 0 ít thì nhiều đến từ Panama Papers và Paradise Papers....uổng thiệt là uổng !

Ừ , biết về chết tại sao phải về ( đừng nói với tôi là về huởng khoan hồng = " Tử hình " nhé) , để chết trong nhục nhã , thà chết nơi xứ người tốt hơn rất nhiều.... rõ ràng bắt cóc , dám làm không dám nhận quá hèn ... dân chúng trong nước không phục là phải rồi.....đối với nước ngoài thì mất hết uy tín tạo dựng bấy lâu nay , rêu rao là tôn trọng pháp luật quốc tế....

truớc khi xữ thành này .. tụi Đức nên đuổi cái đám làm ăn tào lao, rừng rú, chẳng coi pháp luật châu âu ra gì về nuớc .. để lũ chúng nó không coi thuờng pháp luật quốc tế

ấy ấy,hổng được đâu! những đồng chí ấy có công với cách mạng, quá lắm thì chỉ nhận kỹ luật cảnh cáo là được rồi, cùng là người nhà cả mà!!

nếu ai cũng bị tử hình hết thì tui bảo đảm đất nước này sẽ không còn 1 cán bộ nào hết.

Người bắn tên giỏi lên tiếng I am Robin Hood...Còn TQ thì có người giỏi võ I am Bruce Lee...Nhưng chuyện gì hỏi đến Việt Nam thì I am sorry thôi là xong...Đức đếch có làm gì được Việt Nam nên TXThanh mà có chết xong rồi Việt Nam nói I am sorry là xong...Còn muốn thì tui thế 10 người giống TXThanh được ko...Đức chịu thì tui đưa ko thì thôi...Cùng lắm ko làm ăn 1 thời gian rồi xong...

Chí lý. Cán bộ nào có tài sản trên 5 tỷ mà không có lý do chính đáng (như chăn heo, chạy xe ôm, vợ bán beer ôm hay cắt tóc thanh nữ...) thì xử tủ hình hết !!!

Nghĩ lại ai cũng dễ dàng nhận ra rằng, chính phủ Đức chỉ nghĩ đến cái lợi chứ thằng Thanh này sao mà sánh bằng Trần Huỳnh Duy Thức, Lê thị Công Nhân, Mẹ Nấm vv...Đức lên tiếng phản đối khá to đến nỗi fải dùng stethoskop mới nghe...buồn nhỉ...
