Old  Question Người Việt bị Mỹ trục xuất sẽ ra sao?
Công dân Việt bị Mỹ trục xuất là vấn đề Mỹ - Việt Nam đang họp bàn đưa ra giải pháp. Theo thoả thuận, người bị trục xuất được nhận phù hợp với luật pháp và các điều khoản. Những người phạm tội nặng sẽ không có cơ hội trở lại Mỹ.


Chính phủ hai nước Mỹ và Việt Nam hôm Thứ Tư, 5 Tháng Bảy, có cuộc họp đầu tiên bàn về những vấn đề liên quan đến việc nhận lại công dân Việt Nam có lệnh trục xuất khỏi Hoa Kỳ, trong chương tŕnh tăng cường đối tác toàn diện giữa hai nước, thông cáo của ṭa đại sứ Mỹ tại Hà Nội cho biết.


Nghi can B́nh Thái Lục, bị tố cáo giết năm người ở San Francisco, nằm trong diện bị trục xuất về Việt Nam.

Ṭa đại sứ cho biết, cuộc họp này được thực hiện theo tinh thần nhóm làm việc song phương do Thủ Tướng Nguyễn Xuân Phúc và Tổng Thống Donald Trump thiết lập, sau khi hai người gặp nhau tại Ṭa Bạch Ốc, Washington, DC hôm 31 Tháng Năm.


Theo trang web của ṭa đại sứ Việt Nam tại Hoa Kỳ, hôm 22 Tháng Giêng, 2008, ông Đào Việt Trung, thứ trưởng Bộ Ngoại Giao Việt Nam, và bà Julie Myers, phụ tá bộ trưởng Bộ Nội An Hoa Kỳ, có kư một thỏa thuận nhận những người Việt Nam bị Hoa Kỳ trục xuất.

Theo thỏa thuận này, những người bị trục xuất bao gồm công dân Việt Nam và không phải là công dân Hoa Kỳ, hoặc bất cứ nước nào khác; trước đây từng sống ở Việt Nam và hiện không được quốc gia thứ ba nhận; vi phạm luật pháp Hoa Kỳ và bị cơ quan thẩm quyền ra lệnh trục xuất; và hoàn tất án tù v́ vi phạm tội h́nh sự.

Theo thỏa thuận này, Việt Nam chỉ nhận những người qua Mỹ sau ngày 12 Tháng Bảy, 1995, ngày mà Việt Nam và Hoa Kỳ chính thức thiết lập quan hệ ngoại giao.

Cũng theo ṭa đại sứ Việt Nam, việc nhận những người Việt Nam bị Hoa Kỳ trục xuất phải được thực hiện trên căn bản trật tự và an toàn, phù hợp với luật pháp Mỹ, luật quốc tế, và những điều khoản trong thỏa thuận, bao gồm tính nhân đạo, đoàn tụ gia đ́nh, và những trường hợp đặc biệt của từng cá nhân người bị trục xuất, với tinh thần tôn trọng phẩm giá của người bị trục xuất.

Khi được hỏi về chuyện này, Luật Sư Darren Nguyễn Ngọc Chương của Tổ Hợp Luật Sư Nguyễn & Lưu ở Irvine, cho biết: “Đối với những ai đă có lệnh trục xuất và hiện đang được thả lỏng, th́ không thể thay đổi kết quả này. Tuy nhiên, họ vẫn có thể yêu cầu ṭa mở lại hồ sơ. Trong 180 ngày kể từ ngày ra lệnh trục xuất, người khiếu nại sẽ dễ dàng xin ṭa mở lại hồ sơ hơn, v́ sau thời hạn ba tháng th́ người này phải cần có lư do chính đáng mới được ṭa xem xét lại hồ sơ.”

Về chi phí cho người bị trục xuất trở lại Việt Nam, luật sư cho biết: “Hoa Kỳ sẽ mua vé máy bay, tuy nhiên, khi những người này đáp xuống phi trường ở Việt Nam th́ họ thuộc trách nhiệm của chính quyền Việt Nam. Mỹ không có khoản trợ cấp nào khác ngoài tiền vé máy bay.”

Nhân dịp này, Luật Sư Darren cũng giải thích thêm một số điều liên quan đến trục xuất.

“Đối với những ai bị trục xuất th́ phải ra ṭa, nhưng nếu sau khi xin mà ṭa không tha th́ họ bị lệnh trục xuất. Dù là tội nặng hay nhẹ, nếu tội của người này nằm trong danh sách tội được lệnh trục xuất, họ phải hoàn thành mức án tù trước rồi mới bị trục xuất,” ông Darren nói. “Một số tội nằm trong diện này gồm ăn cắp vặt, ẩu đả vợ chồng, nạn nhân bị thiệt trên $10,000, những tội gây hại đến nhân phẩm, và nhiều tội khác.”

Ông cũng khuyên rằng: “Khi bị truy tố, đừng nên thấy tội nhẹ mà nhận v́ vấn đề này rất nguy hiểm. Chúng ta chớ nên nhận tội bừa băi.”

Khi được hỏi liệu những người bị trục xuất có quay lại Mỹ được không, ông cho biết: “Tùy theo từng trường hợp và nguyên nhân họ bị trục xuất mới có thể đưa ra quyết định chính xác. Tuy nhiên, theo thường lệ th́ người bị trục xuất không được nhập cảnh vào Hoa Kỳ trong 10 năm.”

Ông cũng nói thêm, những ai phạm tội nặng (aggravated felony) sẽ không bao giờ được nhập cảnh trở lại vào Mỹ.

Phóng viên nhật báo Người Việt có liên lạc với ṭa tổng lănh sự Việt Nam tại Houston, Texas, để hỏi thêm chi tiết, nhưng một nhân viên tên Thọ Trần, không nêu chức vụ, cho biết ông không đủ thẩm quyền để trả lời và văn pḥng chỉ trả lời khi có văn bản gởi đến.

Nhửng lủ nầy chỉ là đám ăn hại, ngu dốt trốn chui , trốn nhủi trong ở nhửng nơi có người Việt ăn bám.

haha con bà mày! Tiếng Anh th́ viết không rành, nói chuyện với Mỹ chắc dùng động từ to quơ đến mỏi tay, c̣n tiếng mẹ đẻ chưa ǵ đă quên. Sao không nhờ tên nào mày mướn làm thơ giùm cho mày tháng trước đó để post giùm để khỏi mang nhục? Tŕnh độ của dư lơn viên vẹm thật là ấn tượng
