VBF-Thật quá bất ngờ với t́nh h́nh hiện nay khi nhiều người tỵ nạn gốc Việt ở Mỹ cũng bị bắt giam và c̣n nguy cơ trục xuất. Thế nhưng nếu có trục xuất th́ họ về đâu?Có những thỏa thuận giữa Mỹ và Việt Nam là những người Việt tỵ nạn sang trước 95 là không thể trục xuất. Nhưng mới đây có đến 100 người Việt giam giữ, và trong đó có người tỵ nạn.

Philadelphia, PA - Trong tháng vừa qua, cộng đồng người Mỹ gốc Việt đă bị rung chuyển bởi việc gia tăng bắt và giam giữ những người Mỹ gốc Việt và họ có thể bị trục xuất. Chỉ trong hai tuần đầu tiên của tháng 3, các nhà tổ chức biết rằng gần 100 người Việt đang bị giam giữ, phần lớn là Trại giam Quận York ở Pennsylvania và tạm giam Krome ở Florida.

Jessica Shullruff Schneider, một luật sư luật di trú và giám thị chương tŕnh "Detention Watch" của tổ chức American for Immigrant Justice ở Miami, FL, đă nói chuyện với một số người vừa mới bị giam tại cơ sở tạm giam Krome. Bà nhận xét "rơ ràng là hầu hết những người bị giam đă lớn lên và ăn học ở Hoa Kỳ, có gia đ́nh, và việc làm, những thành viên của cộng đồng người Việt đang bị giam chủ yếu là v́ những lầm lỗi lâu năm trước." Bà Schneider nói thêm, "Khi luật di trú khắc nghiệt được thi hành mù quáng như thế này, sẽ thường dẫn đến các hậu quả bất công."
Những người tị nạn Đông Nam Á từ Việt Nam, Campuchia, và Lào đến Hoa Kỳ với số lượng lớn sau hậu quả của chiến tranh Mỹ tại Việt Nam. Hơn 1 triệu người chạy trốn bạo lực, diệt chủng, và đói khát đă được tái định cư tại Hoa Kỳ giữa năm 1975 và 1995, là cuộc tái định cư người tị nạn lớn nhất trong lịch sử Hoa Kỳ. Những năm tiếp theo cũng cho thấy sự gia tăng trong di trú từ Việt Nam, khi mà ngày càng nhiều người tái đoàn tụ gia đ́nh thông qua các bản kiến nghị xin visa theo diện gia đ́nh.

Tương tự như các cộng đồng Đông Nam Á khác, những người tị nạn Việt Nam chủ yếu tái định cư tại các khu vực nghèo tài nguyên và nguồn lực trong nước Mỹ. Hậu quả là, họ phải đối mặt với đói nghèo cùng cực và kỳ thị chủng tộc trong cộng đồng mới của ḿnh, khiến nhiều người bị ảnh hưởng tâm lư nặng nề với cảm giác bị cô lập. Sự trỗi dậy của hệ thống công nghiệp nhà tù vào những năm 1980 và 1990 dẫn đến cầm tù và buộc tội hàng loạt, khiến cho nhiều người Việt tị nạn và di dân trẻ bị kẹt vào hệ thống công lư h́nh sự.
“Người Việt đă dính vào hệ thống công lư h́nh sự nhiều hơn bất kỳ cộng đồng Đông Nam Á nào khác,” anh Tùng Nguyễn, người sáng lập APIROC (Asian Pacific Island Re-Entry Orange County - Tổ chức đấu tranh cho sự tái hoà nhập của những người Châu Á Thái B́nh Dương từng bị cầm tù tại quận Cam), cho biết. Bản thân anh Tùng trước đó đă bị cầm tù 18 năm. “Vẫn c̣n nhiều định kiến trong cộng đồng ḿnh [về những người từng bị cầm tù] mà đă khiến cho chúng ta tiếp tục giữ im lặng về những vấn nạn này.”

Trong số những người tị nạn Đông Nam Á, việc giam giữ và bắt buộc trục xuất đă ảnh hưởng lên cộng đồng Campuchia nặng nề nhất. Điều này hầu như là bởi v́ bản Thoả thuận Hồi hương đă kư giữa Hoa Kỳ và Việt Nam đă ngăn chặn việc trục xuất các cá nhân đến Mỹ trước năm 1995. Hơn nữa, chính phủ Việt Nam không chấp nhận các các nhân không thể chứng minh quốc tịch hay thường trú của họ trước đó tại nước này.
“Do các điều khoản cụ thể trong bản thoả thuận với Việt Nam, cộng đồng chúng tôi cứ đinh ninh là ḿnh sẽ được bảo vệ khỏi việc trục xuất,” cô Nancy Nguyễn, Giám đốc Điều hành của VietLead, một tổ chức cộng đồng tại Philadelphia, cho hay. “Nhưng chính quyền mới đă cho ICE thêm quyền hạn để giam cầm và giám sát cộng đồng chúng tôi - và kết quả là sự gia tăng đáng lo ngại các vụ giam cầm mới, thậm chí đối với những các nhân mà theo bản thoả thuận giữa Mỹ và Việt Nam là không thể bị trục xuất được.”

Ông Vinh Lư là một trong những cá nhân này. Sinh ra trong một trại tị nạn năm 1982, ông đến Mỹ từ Việt Nam vào năm 1989 cùng gia đ́nh ḿnh. Ông bị dính líu trong một vụ án liên quan đến ma tuư vào năm 2002 khi ông mới 20 tuổi. Ông Vinh, bị cầm tù vào năm 2002, đă đến trụ sở của ICE để tŕnh diện hàng năm kể từ đó. Ông đâm nghi khi một nhân viên ICE yêu cầu anh tŕnh diện sớm hơn hạn, và ông đă liên lạc những người tổ chức lân cận từ 1Love Movement và Vietlead. Theo ông Vinh cho hay, “Tôi cảm thấy lạc lơng và sợ hăi và không nghĩ là điều này sẽ lại xảy ra với tôi v́ tôi không phù hợp với các điều kiện dưới bản thoả thuận giữa Mỹ và Việt Nam.” Ông Vinh đă thực sự bị ICE giam cầm.

Nhờ phản ứng nhanh từ những người biện hộ, những người tổ chức, cùng những người ủng hộ ḿnh, ông Vinh đă được ICE thả ra khỏi trại giam trong ṿng 24 tiếng, nhưng ngay sau đó lại bị c̣ng tay lại và đưa lên một chiếc xe buưt từ Philadelphia đến Trung tâm Giam cầm Quận York. “Khi tôi được thả ra, việc đầu tiên mà tôi muốn làm là về nhà với gia đ́nh,” ông Vinh cho hay.

Khi mà các tổ chức cộng đồng toàn quốc đă bắt đầu nhận các cuộc gọi từ các cá nhân người Việt bị ảnh hưởng cùng gia đ́nh họ, những người tổ chức và biện hộ người Việt đă phản ứng trước cuộc khủng hoảng này qua việc thành lập một mạng lưới hỗ trợ toàn quốc. “Các gia đ́nh người Mỹ gốc Việt đang đối mặt với nguy cơ bị trục xuất cần được biết là họ không cô độc,” Cô Quyên Đinh, Giám đốc Điều hành của SEARAC (Southeast Asia Resource Action Center - Trung tâm Hành động Nguồn lực Đông Nam Á), cho hay. “Họ có cả một cộng đồng đang đấu tranh cho họ.”

“Chúng tôi đang tổ chức trong cộng đồng ḿnh và khuyến khích những người bị ảnh hưởng trực tiếp t́m kiếm giúp đỡ thay v́ giữ im lặng,” anh Tùng Nguyễn từ APIROC cho biết thêm. “Luật di trú và công lư h́nh sự không công bằng và chúng ta cần vận động để chấm dứt điều này xảy ra với cộng đồng của chúng ta."

Facing an Emboldened ICE -
Detentions of Vietnamese Nationals Spike
Across Country Under New Administration

Philadelphia, PA - In the past month, the Vietnamese American community has been rocked by a surge of community members apprehended and detained for possible deportation. In the first two weeks of March alone, organizers learned that nearly 100 Vietnamese people were being detained, largely at York County Detention Center in Pennsylvania and Krome Detention Facility in Florida.
Jessica Shullruff Schneider, immigration lawyer and supervisor to the Detention Watch program at Americans for Immigrant Justice in Miami, FL, spoke with a number of the recent detainees at the Krome facility. She commented, “it is abundantly clear that many are people who were raised in the United States, have young families, and are productive members of our communities are being detained because of long-ago mistakes." Schneider added, "When our harsh immigration laws are enforced blindly like this it often leads to unjust results."

Southeast Asian refugees from Vietnam, Cambodia, and Laos came to the US en masse in the aftermath of the Vietnam War. Over 1 million people fleeing violence, genocide and starvation were resettled in the US between 1975 and 1995, the largest resettlement of refugees in US history. The following years also saw a rise in Vietnamese immigration, as people reunited with their loved ones through family-based visa petitions.
Similar to other Southeast Asian communities, Vietnamese refugees were primarily resettled in resource-poor areas in the US. As a result, they faced extreme poverty and racism in their adopted communities, leaving many re-traumatized and isolated. The rise of the prison industrial complex in the 1980s and 1990s led to mass incarceration and criminalization, leaving many young Vietnamese refugees and immigrants entrapped in the criminal justice system. “More Vietnamese came into contact with the criminal justice system than any other Southeast Asian community,” said Tung Nguyen, founder of APIROC (Asian Pacific Island Re-Entry Orange County). Nguyen is himself formerly incarcerated for 18 years. “However, there is still such a stigma in our community that it keeps us silent on these issues.”

Among Southeast Asian refugees, the issue of mandatory detention and deportation has most deeply impacted the Cambodian community. This is largely because the unique US-Vietnam repatriation agreement (also known as memorandum of understanding, or MOU) limits the removal of indivwho came to the US pri 1995. Addit the Vietnamese government does not accept those that are unable to prove nationality or prior residence in Vietnam.
“Due to the specific provisions in the Vietnamese agreement, our community thought they would be protected from deportation,” says Nancy Nguyen, the Executive Director of VietLead, a community based organization in Philadelphia. “But the new administration has given ICE new license to detain and surveil our communities - and the result has been a serious upsurge of new detentions, even for individuals who cannot be deported under the MOU.”
Vinh Ly was one of these individuals. Born in a refugee camp in 1982, he came to the US in 1989 with his family from Vietnam. He got caught up in a drug case in 2002 when he was 20. Ly, who was incarcerated in 2002, had been checking in with ICE under supervision ever since. He became suspicious when his ICE officer asked him to check-in earlier than usual and contacted local advocates from 1Love Movement and VietLead. According to Ly, “ I felt lost and scared and didn't know [I would be detained again] because I didn't fit under the MOU. Once I got to York, PA I met another guy in the same situation I was in. We both didn't know why we were being detained.” Ly was in fact detained by ICE.

With quick action from advocates, organizers and supporters, Mr. Ly was released from ICE detention within 24 hours, but only after after he was shackled and put on a bus from Philadelphia to York County Detention Center. “When I got out, the first thing I wanted to just to get home to my family,” said Ly.
As community organizations across the country have started to field calls from impacted Vietnamese individuals and their families, Vietnamese organizers and advocates have responded to the crisis by forming a national support network. “Vietnamese American families facing the threat of deportation need to know they are not alone,” said Quyen Dinh, executive director of the Southeast Asia Resource Action Center (SEARAC). “They have a whole community fighting for them.”
“We are organizing in our communities and encouraging them to seek help rather than staying quiet,” added Tung Nguyen from APIROC. “Our immigrant and criminalization laws are unjust and we need to mobilize to end this in our communities.”

Thật ra cũng không có ǵ bất ngờ khi người Việt bị trục xuất , rất có nhiều người bị trục xuất trước khi Trump lên nắm quyền rồi , ai qua sau năm 95 dù gia cánh ra sau , một khi phạm pháp sẽ bị trục xuất.....
