VBF-Một bà bị bắt dù có quốc tịch Mỹ trong tay. Theo đó cô con gái phải an ủi bà trong những ngày này. Bà đă vào quốc tịch cách đây 20 năm trời.

LOS ANGELES – Liên đoàn Tự do Dân sự Mỹ (ACLU) và một văn pḥng luật sư cùng đại điện một phụ nữ mang quốc tịch Mỹ ở San Bernardino khởi kiện ICE (Cơ quan Thực thi Quan thuế và Di trú) và Cảnh sát quận v́ đă bị bắt giữ sai trái.

Guadalupe Plascencia – 60 tuổi – bị tạm giam vào tối ngày 29 tháng 3 liên quan đến trát toà kéo dài cả thập niên về cáo buộc không chịu ra làm nhân chứng trong một phiên toà. Theo lời người phụ nữ, cảnh sát quận Bernadino vào tối hôm đó yêu cầu bà kư giấy tờ thừa nhận rằng nhân viên ICE đă hỏi h́nh trạng di trú của bà.

Khi người phụ nữ rời khỏi trại giam West Valley ở Rancho Cucamonga, các nhân viên thực thi di trú đă chờ sẵn bên ngoài, c̣ng tay và đưa bà vào chiếc xe van. Cả ngày sau bà bị ICE giam giữ. Người phụ nữ lo sợ ḿnh sẽ bị trục xuất mặc dù đă vào quốc tịch cách đây 20 năm. Cuối cùng, bà được thả ra sau khi được phép nói chuyện với con gái, người ngay lập tức cầm hộ chiếu của mẹ ḿnh đến tŕnh nhà chức trách.

Plascencia vào hôm thứ Ba đă khởi kiện cơ quan thực thi di trú liên bang và Ty cảnh sát quận San Bernadino. Vụ kiện cho rằng, người phụ nữ bị tạm giam không có lư do chính đáng, chẳng qua là do sắc tộc mà ra. Vụ kiện đ̣i bồi thường thiệt hại không xác định và bồi thường mang tính răn đe do khám xét, bắt giữ bất hợp lư, bắt giữ sai trái, cầm tù sai trái và vi phạm bảo vệ công bằng trước pháp luật.

Vụ kiện cũng cho rằng, người ta cố t́nh tŕ hoăn việc thả Plascencia khỏi nhà tù quận San Bernadino để nhân viên di trú có thời gian đến bắt bà.

Các luật sư cho rằng, việc bắt và giam giữ sai trái là do các nhân viên ICE đă sử dụng thông tin trong kho dữ liệu điện tử mặc dù chúng chưa hoàn thiện và dễ gặp lỗi.

Đại diện cảnh sát quận San Bernadino phủ nhận việc liên lạc ICE hay yêu cầu bà Plascencia khai t́nh trạng di trú. Phía cảnh sát lập luận rằng, việc này sẽ vi phạm chính sách của Ty cảnh sát. Phát ngôn nhân ICE vào lúc đó xác nhận, cơ quan sẽ không thực thi hay giam giữ ai nếu có bằng chứng chỉ ra người đó là công dân Mỹ.

Thật t́nh không hiểu bài này muốn nói ǵ...

1/ Nếu bà ta có bị tội v́ không chịu ra làm nhân chứng ǵ ǵ đó th́ đâu là công việc của ICE phải lo?

2/ Trát ṭa dài cả 10 năm th́ lúc đó bà ta đă là công dân Mỹ (từ 10 năm trước đó nữa) và vẩn không phải chuyện của ICE.

3/ Bà này đâu phải người Việt ở Mỹ mà là người từ Latin America, vậy bài này cũng không thích hợp trong nhóm này hihi
